1. Scope
These Terms of Service apply to the use of the ReciBee App (hereinafter "App") by the provider: Lukas Schachtmaier & Johann Warkentin GbR Rosenstraße 19, 38550 Isenbüttel, Germany info@honeyapps.de By registering and using the App, the user accepts these Terms of Service.
2. Service Description
The App allows users to: • Create, manage, and share their own recipes • Import recipes from the web, social media platforms, and from photos • Capture recipes via voice input • Use AI-powered features (image recognition, nutrition calculation, voice assistant) • Organize recipes in families and groups • Create meal plans and shopping lists • Discover, comment on, and save public recipes from other users The App is available in a free basic version. Certain features may be offered as paid extensions (in-app purchases or subscriptions). The scope and prices of paid features are transparently displayed in the App before a purchase is completed. The free version of the App contains advertisements from Google AdMob. Details about data processing by AdMob can be found in the Privacy Policy (Section 3c).
2a. In-App Purchases and Subscriptions
The App offers optional paid features through subscriptions. Auto-Renewal: • Subscriptions automatically renew at the end of each billing period unless canceled in time. • Your Apple or Google account will be charged upon each renewal. Cancellation: • iOS: Settings → [Your Name] → Subscriptions → ReciBee → Cancel Subscription • Android: Google Play Store → Payments & Subscriptions → Subscriptions → ReciBee → Cancel • Cancellation takes effect at the end of the current billing period. Refunds: • Refunds are handled according to Apple or Google policies. • For questions, contact us at info@honeyapps.de.
2b. Right of Withdrawal for Digital Content
As a consumer, you generally have a 14-day right of withdrawal under German law (§ 355 BGB). For digital content not delivered on a physical data carrier (e.g., in-app purchases, subscription features), this right of withdrawal expires under § 356(5) BGB once performance of the contract has begun, provided that: • you have expressly consented to performance beginning before the end of the withdrawal period, and • you have confirmed that by giving your consent you lose your right of withdrawal. Before purchasing an in-app purchase or subscription, you will be informed of these legal consequences in the App and must expressly confirm them. By confirming and completing the purchase, you waive your right of withdrawal. This does not affect any additional refund policies offered by Apple or Google, which continue to apply. 3. Registration and Account
Using the App requires registration with a valid email address or through a supported third-party provider (e.g., Google, Apple). The user is responsible for the security of their login credentials and all activities carried out through their account. The user can delete their account at any time in the profile settings. Use of the app requires a minimum age of 16. Users under 16 may only use the app with the consent of a parent or legal guardian.
4. User Conduct
The user agrees to: • Not publish any unlawful, offensive, or misleading content • Not infringe on third-party copyrights (e.g., recipe images or imported content) • Not use the App in an abusive or automated manner • Review AI-generated content for accuracy before publishing • Not import or share content for which they do not have the appropriate usage rights The provider reserves the right to remove content and suspend accounts that violate these rules.
5. AI-Powered Features
The App offers the following AI-powered features based on Google Gemini: • Image-to-Recipe: Automatic recognition of recipes from photos • Speech-to-Recipe: Structuring ingredients and steps from voice input • Nutrition Calculation: Automatic estimation of calories, protein, carbohydrates, and fat • Recipe Generation: Create recipes from available ingredients • Recipe Modification: Modify existing recipes via AI (e.g., make it vegan) • Food Identification: Identify ingredients from photos • Text Analysis: Structure free-text input and imported content Important notes: • AI-generated results (recipe data, nutritional values) are estimates and may contain errors. They do not replace professional nutritional or health advice. • Nutritional information is approximate and provided without guarantee. • Imported or AI-recognized recipes may contain inaccuracies. The user is responsible for reviewing content before use and sharing. • Using AI features requires an active internet connection and the transmission of data to third-party services (Google). Details can be found in the Privacy Policy.
6. Recipe Import from Third-Party Sources
The App allows importing recipes from websites and social networks (e.g., Instagram, TikTok, Pinterest, Chefkoch). • The user is solely responsible for ensuring that they are authorized to use and store the imported content. • Copyrights to imported recipes, texts, and images remain with the respective rights holder. • Imported content may not be shared as public recipes in the App unless express permission from the rights holder has been obtained. • The provider assumes no responsibility for the availability, completeness, or accuracy of content on third-party platforms.
7. Liability
The App is provided "as is". The provider is not liable for: • Accuracy or completeness of user-generated or imported recipes • Nutritional information (automatically estimated by AI, without guarantee) • Accuracy of AI-recognized or AI-generated content (e.g., from photos or voice input) • Copyright infringement through content imported or shared by the user • Temporary unavailability of the App or third-party AI services (e.g., Google Gemini) • Data loss due to force majeure Liability provisions: • The provider is liable without limitation for damages resulting from injury to life, body, or health, as well as for damages under the German Product Liability Act (Produkthaftungsgesetz), in accordance with statutory provisions. • For other damages, the provider is liable without limitation in cases of intent and gross negligence. • In cases of slight negligence leading to a breach of material contractual obligations (cardinal duties — obligations whose fulfillment is essential for the proper performance of the contract and on which the user may reasonably rely), liability is limited to the damages typically foreseeable for this type of contract. • Liability for slight negligence is otherwise excluded.
8. Intellectual Property
The App itself (design, code, trademarks) is the property of the provider. Content created by the user (recipes, images, texts) remains the property of the user. By sharing recipes as "public", the user grants other App users a simple, non-exclusive right of use to view and save these recipes. For imported content from third-party sources, the rights of the respective author or rights holder apply.
9. Changes to the Terms of Service
The provider reserves the right to change these Terms of Service at any time. Significant changes will be communicated to users through the App. Continued use of the App after changes constitutes acceptance.
10. Final Provisions
The law of the Federal Republic of Germany applies. Should individual provisions of these Terms of Service be invalid, the validity of the remaining provisions shall remain unaffected. The European Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr/ We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
